Nick of Time Endeavors, LLC - Terms of Use and Services ("Terms")

By using and/or accessing www.nickoftimeofficial.com, www.note-records.com, www.musicbynote.com, and any and all sub-domains (collectively referred to as "The Website"), you (including representatives, agents, contractors, affiliates, employees, and so forth: collectively referred to as"The User") are automatically agreeing to be subject by these Terms set by Nick of Time Endeavors, LLC ("The Company") in their entirety, without modification.

1) These Terms are effective on the date (the “Effective Date”) The User accepts the terms herein or first accesses, downloads or uses any of the services or information (collectively referred to as the “Services”) on the site and remain in effect for so long as The User uses or accesses any of the Services (the “Term”). Upon termination of the Term, The User is no longer permitted to use or access the Services. The Terms herein that contemplate obligations after the Term, including but not limited to Sections/Paragraphs 2, 3, 4, 5, and 6 listed below, will survive termination.

2) The User is strictly prohibited from all of the following and must not:

lease, sell, copy, sublicense, transfer, or assign any information, data, intellectual property, products, goods or services provided on The Website. Including, but not limited to: musical compositions, musical recordings, lyrics, photos, images, graphics, logos, and merchandise
use The Website for any illegal purpose
gain unauthorized access to The Company’s data or the data of other users
alter, modify, adapt, reverse engineer, decompile, disassemble, or hack The Company’s intellectual property or data
alter or modify another website to falsely imply that it is associated with The Company’s Website
use or export The Company’s information, data, intellectual property, products, goods or services in violation of U.S. export laws and regulations
violate anyone else’s legal rights (including, but not limited to: privacy rights) or any laws (including, but not limited t: copyright laws)
use The Website or The Company’s services to transmit content that could be deemed unlawful, threatening, harassing, racist, abusive, libelous, pornographic, vulgar, defamatory, obscene, indecent, or otherwise inappropriate, including any messages constituting or encouraging criminal conduct
breach, or attempt to breach, The Website’s security systems, and
enable third parties to violate these Terms

3) In the event that The User violates any of these Terms or applicable laws, then The User must be responsible for indemnifying Nick of Time Endeavors, LLC for any losses or damages The Company incurs as a result. Furthermore, Nick of Time Endeavors, LLC must not be held responsible for any costs, expenses, or payments in connection with any claim involving The User.

4) The User agrees that any and all of the information The User submits or transmits fully complies with the law and acknowledges that Nick of Time Endeavors, LLC must not be liable whatsoever for The User’s misuse of their data. Nick of Time Endeavors, LLC retains the right to revoke or restrict The User’s access to this website, products, or services in the event that The User violates these Terms or any applicable law. The User represents that they are either the exclusive owner of their data or have the proper licenses or consents to use the data, and that Nick of Time Endeavors, LLC will not be at risk of infringing any intellectual property rights of third parties.

5) In the event that The User violates any of these Terms or applicable laws, then The User must be responsible for indemnifying Nick of Time Endeavors, LLC for any losses or damages The Company incurs as a result. Furthermore, Nick of Time Endeavors, LLC must not be held responsible for any damages, loss, or dollar amount in connection with any claim involving The User. Nick of Time Endeavors, LLC is not responsible for any misuse or loss of data pertaining to The User.

6) Any purchase from The Website will automatically add The User to the Nick of Time Electronic Mailing List (The "Mailing List"), which The User is able to unsubscribe from for any reason at any time. All music sales are final. All sticker sales are final. T-shirt sales are able to be returned within 30 days of purchase as long as the T-shirt has not been washed or damaged; The Buyer (The User) is responsible for all costs associated with shipping the item to be returned for a refund or exchange.

7) Your information is safe with me. I respect your privacy, and any information you share with me will stay between us. Period.
